Acceptance of These Terms
Welcome to 5toolprospects.com (the “Site”), operated by 5 Tool Prospects (“5TP,” “we,” “us,” or “our”), a nonprofit youth baseball organization based in Arizona. By accessing or using the Site, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the Site.
Use of the Site
The Site provides information about our training academy, teams, tryouts, and other programs, and lets you express interest, contact us, and donate. You agree to use the Site only for lawful purposes and to provide accurate information when you submit any form.
Interest Forms Are Not Registration
Submitting an interest or inquiry form does not enroll an athlete in any program, reserve a roster spot, or create any obligation on the part of 5TP. Participation in our programs is subject to separate registration, program agreements, waivers, and payment terms provided at the time of enrollment.
Athletic Programs and Assumption of Risk
Baseball and athletic training involve inherent risks. Any participation in 5TP programs is governed by the written waivers and agreements signed at registration, not by these Terms. Information on the Site about training, education options, or athlete development is general information only and is not medical, educational, or professional advice.
Donations
Donations made through the Site are voluntary and are processed by third-party payment processors subject to their own terms. If you have a question about a donation, or need a receipt or documentation regarding deductibility, contact us at hello@5toolprospects.com.
Communications
By submitting a form with your contact information, you agree that we may contact you by email or phone about your inquiry. Text messages are sent only with your consent and are governed by the SMS terms in our Privacy Policy. You may opt out of marketing communications at any time.
Intellectual Property
The Site and its content, including the 5TP name, logo, text, graphics, photos, and video, are owned by 5TP or its licensors and are protected by copyright and trademark law. You may view and share Site content for personal, noncommercial purposes. Any other use requires our prior written permission.
Prohibited Conduct
You agree not to misuse the Site, including by attempting to gain unauthorized access to any systems, interfering with the Site’s operation, submitting false or misleading information, scraping or harvesting data, or using the Site to transmit anything unlawful, harassing, or harmful.

You agree to indemnify and hold harmless 5TP and its directors, officers, coaches, volunteers, and agents from claims arising out of your violation of these Terms or misuse of the Site.

We may revise these Terms from time to time. The effective date above shows when they were last updated. Continued use of the Site after changes are posted means you accept the revised Terms.
Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Maricopa County, Arizona.
